1. Acceptance of Terms
By accessing or using ThinContext.ai ("Service"), operated by SoftFinity Corp ("Company", "we", "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and SoftFinity Corp.
2. Description of Service
ThinContext.ai is a SaaS platform that accepts video uploads and analyzes them through a multi-stage AI pipeline. The Service scans video content frame by frame to detect presentation slides, speakers, on-screen text, and scene transitions; transcribes audio into text; merges visual context with the transcript; and processes the fused data through a large language model (LLM) to produce structured, LLM-friendly text output. This output is optimized for consumption by Claude, Gemini, Perplexity, ChatGPT, and other large language models.
3. Account Registration
To access certain features, you may need to create an account. You agree to:
- Provide accurate, current, and complete information
- Maintain the security and confidentiality of your account credentials
- Notify us immediately of any unauthorized use of your account
- Accept responsibility for all activities conducted under your account
4. Subscription Plans and Payment
We offer Free, Starter, Pro, and Enterprise plans. Paid plans are billed monthly or annually through Polar, our Merchant of Record. By subscribing, you authorize us to charge your payment method on a recurring basis.
- Prices are listed on our pricing page and may change with 30 days' notice
- Refunds are available within 14 days of initial purchase if no videos have been processed
- You may cancel your subscription at any time; access continues through the end of the current billing period
- All payment transactions are processed through Polar, which handles billing, sales tax, VAT, and GST globally; we never store, process, or transmit cardholder data on our own servers
5. Acceptable Use
You agree not to:
- Upload content you do not have the right to use or distribute
- Upload content that is illegal, harmful, threatening, defamatory, or infringes on third-party rights
- Upload content containing malware, viruses, or other harmful code
- Attempt to reverse-engineer, decompile, or disassemble the Service or its underlying algorithms
- Use the Service to develop a competing product or service
- Circumvent usage limits, access controls, or security mechanisms
- Use automated tools, bots, or scrapers to access the Service without our express written permission
- Share, resell, or sublicense your account or access credentials
6. Intellectual Property
You retain all ownership rights to the videos you upload and the content contained within them. The structured text output generated from your videos is yours to use without restriction. We retain all rights to the Service itself, including its technology, processing pipeline, branding, user interface, and proprietary algorithms. Nothing in these Terms transfers any intellectual property rights in the Service to you.
7. Data, Content, and Media Handling
We treat all user-uploaded media and generated outputs with strict data-handling controls:
- Temporary processing only: Uploaded videos, extracted audio, intermediate processing artifacts, and generated LLM-friendly text outputs are stored only for the duration necessary to complete analysis and deliver results to you
- Automatic purging: All media files — including source video, extracted audio tracks, frame captures, and generated text outputs — are permanently purged from our storage systems as soon as processing is complete and results have been delivered to your account. No media is retained beyond operational necessity
- No model training: We do not use your uploaded videos, audio, transcripts, or generated outputs to train, fine-tune, or improve any AI or machine-learning models
- User-controlled output: Generated text outputs remain accessible in your account dashboard until you choose to delete them. Account deletion triggers permanent removal of all associated data
- Enterprise retention: Enterprise customers may negotiate custom data-retention schedules under a separate Data Processing Agreement (DPA)
8. Security and Encryption
We implement comprehensive security measures to protect your data throughout its lifecycle:
- Encryption in transit: All data transmitted between your device and our servers is protected by TLS 1.2+ encryption. This applies to video uploads, API calls, account interactions, and output delivery
- Encryption at rest: All stored data — including uploaded media, processing artifacts, account information, and generated outputs — is encrypted at rest using AES-256 encryption
- End-to-end protection: The entire data pipeline, from upload through processing to output delivery, operates within encrypted channels. Data is never transmitted or stored in unencrypted form at any stage
- Access controls: Internal access to customer data is restricted to authorized personnel on a need-to-know basis, enforced through role-based access control (RBAC) and multi-factor authentication
- Infrastructure security: Our infrastructure employs firewalls, intrusion-detection systems, continuous monitoring, and regular security audits
9. Regulatory Compliance
ThinContext.ai is designed and operated to support compliance with the following regulatory frameworks:
- PII (Personally Identifiable Information): We handle all personally identifiable information in accordance with applicable data-protection laws, including the California Consumer Privacy Act (CCPA) and the General Data Protection Regulation (GDPR). PII is collected only as necessary, encrypted at all times, and never sold
- PCI DSS (Payment Card Industry Data Security Standard): All payment processing is performed by Polar, our Merchant of Record. We do not store, process, or have access to credit card numbers or full payment card data on our systems
- PHI (Protected Health Information): For customers who upload content containing protected health information, we maintain safeguards consistent with PHI handling requirements. Video content and derived outputs containing PHI are subject to the same automatic purging and encryption controls described in these Terms
- HIPAA (Health Insurance Portability and Accountability Act): Our platform maintains administrative, physical, and technical safeguards aligned with HIPAA requirements, including encryption in transit and at rest, access controls, audit logging, and automatic data purging. Enterprise and healthcare customers requiring a Business Associate Agreement (BAA) should contact us to arrange one prior to uploading any PHI
10. No Sale of Data
We do not sell, rent, lease, or trade your personal information, uploaded content, generated outputs, or any data derived from your use of the Service to any third party, under any circumstances. This commitment applies to all data categories, including PII, media files, transcripts, and analytics data.
11. Service Availability
We strive for high availability but do not guarantee uninterrupted service. We may perform scheduled maintenance with reasonable advance notice. Unscheduled downtime may occur due to circumstances beyond our control. Enterprise plans include SLA guarantees with defined uptime commitments and remedies as specified in your Enterprise agreement.
12. Limitation of Liability
To the maximum extent permitted by applicable law, SoftFinity Corp shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, regardless of the cause of action or theory of liability.
Our total aggregate liability for any claims arising from or related to the Service shall not exceed the total amount you paid to us in the twelve (12) months immediately preceding the event giving rise to the claim.
13. Indemnification
You agree to indemnify, defend, and hold harmless SoftFinity Corp and its officers, directors, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.
14. Termination
We may suspend or terminate your access to the Service at any time for violation of these Terms, illegal activity, non-payment, or any conduct that we reasonably determine is harmful to the Service or other users. Upon termination, your right to use the Service ceases immediately. All stored data associated with your account, including any uploaded media and generated outputs, will be permanently purged in accordance with our data-handling practices.
15. Changes to Terms
We may update these Terms at any time. We will notify you of material changes via email or through the Service at least 30 days before the changes take effect. Continued use of the Service after the effective date of updated Terms constitutes your acceptance of those changes. If you do not agree to the updated Terms, you must stop using the Service.
16. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict-of-law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved exclusively in the state or federal courts located in San Francisco County, California. You consent to the personal jurisdiction of those courts.
